1. About TidyEstate

TidyEstate is a trading name of Ark Innovations and Technology Ltd, a company registered in England and Wales (company no. 10152621). Registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.

TidyEstate is a software service that provides guidance and document generation tools for probate and estate administration in England and Wales. TidyEstate is not a law firm, not a solicitor, and not regulated by the Solicitors Regulation Authority.

Nothing on TidyEstate constitutes legal advice. The information and documents provided are intended to assist executors in understanding and completing the probate process — they are not a substitute for qualified legal advice. If you are uncertain about any legal matter, you should consult a solicitor.

2. Eligibility

You must be at least 18 years old to use TidyEstate. By creating an account, you confirm that you are 18 or over and that you have the legal capacity to enter into these terms.

TidyEstate is designed for use with estates in England and Wales only. It does not cover estates subject to Scots law (Confirmation) or Northern Irish law.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

You may not share your account with others. Each executor who needs access to a case should be invited as a co-executor via the app’s co-executor invite feature.

4. Free and paid features

TidyEstate is free to use for the estate profile builder, IHT calculator, and task management features. A one-time payment of £79 per case is required to generate official forms (PA1P, PA1A, IHT400, institution letters) and to access secure document storage.

Prices are shown inclusive of any applicable taxes. VAT is not currently charged. Prices may change with notice to registered users.

5. Payments and refunds

Payments are processed by Stripe. By making a payment, you agree to Stripe’s terms of service. Your card data is never stored on TidyEstate’s servers.

Your right to cancel. Because you are a consumer buying digital content online, you have 14 days from the day of payment to cancel and receive a full refund. When you pay, we ask for your express consent to make the documents available to you straight away and your acknowledgement that, once you generate or download a document, the right to cancel is lost (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 37). If you have not generated or downloaded anything, you can cancel within the 14 days by emailing [email protected] from the address on your account; we refund to the original payment method within 14 days of your notice.

If something is wrong. Separately from the right to cancel, the Consumer Rights Act 2015 entitles you to digital content that is of satisfactory quality, fit for purpose and as described. If a document we generate is faulty, tell us and we will repair or replace it; if we cannot, you are entitled to a price reduction or refund. Nothing in these terms limits those rights.

We will send you a confirmation of your order by email as soon as payment succeeds. Prices include any applicable VAT.

6. Accuracy of documents

TidyEstate generates documents based on the information you provide. The accuracy of generated documents depends entirely on the accuracy of the information you enter. It is your responsibility as executor to ensure that all information entered is correct and complete.

You should review all generated documents carefully before submitting them to HMCTS, HMRC, or any other authority. TidyEstate does not guarantee that generated documents will be accepted by HMCTS, HMRC, or any financial institution.

Form templates are based on official HMCTS and HMRC forms as at the date shown on the form. We aim to keep templates up to date, but cannot guarantee that all forms reflect the most current versions at all times.

7. Will writing

The will writing product generates a will document based on your instructions. A will generated by TidyEstate is legally valid in England and Wales only if it is:

  • Signed by the testator in the presence of two witnesses
  • Witnessed by two independent adults who are present simultaneously
  • Not witnessed by any person who is a beneficiary under the will, or married to / in a civil partnership with a beneficiary

TidyEstate provides signing instructions with each generated will. It is your responsibility to ensure the will is executed correctly. A will that is not properly executed is invalid.

The will writing product is suitable for straightforward estates only. If your situation involves a second marriage, children from multiple relationships, significant business assets, or foreign property, we strongly recommend using a solicitor.

8. Limitation of liability

To the maximum extent permitted by law, TidyEstate will not be liable for:

  • Any loss arising from reliance on information provided by TidyEstate
  • Any loss arising from errors in documents generated by TidyEstate where those errors result from incorrect or incomplete information provided by you
  • Any rejection of documents by HMCTS, HMRC, or any financial institution
  • Any indirect, consequential, or special loss
  • Any loss exceeding the amount you paid to TidyEstate for the relevant case

Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

9. Acceptable use

You must not use TidyEstate to:

  • Submit false, fraudulent, or misleading information to HMCTS or HMRC
  • Administer an estate to which you have no legal entitlement
  • Access another person’s case without their authorisation
  • Attempt to reverse-engineer, scrape, or abuse the service

10. Data and privacy

Your use of TidyEstate is subject to our Privacy policy, which is incorporated into these terms by reference.

11. Changes to the service

We reserve the right to modify or discontinue any feature of TidyEstate at any time. We will provide reasonable notice of material changes that affect paid features.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
